2. The petitioner seeks regular bail in connection with Madanpur P.S. Case No. 133 of 2024 lodged on 28.03.2024 under Section 30(a) of the Bihar Excise Prohibition and Amendement Act 2018
3. As per the prosecution case, F.I.R. has been lodged against the present petitioner alleging that he has served Bhang mixed with Sprite to the guests on the occasion of Holi.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that no excise material has been recovered. Counsel further submits that the criminal antecedent of the petitioner is clean and the petitioner is in custody since

5. Learned APP for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named by granted bail after framing of charge, if the charge is not framed yet and on furnishing bail bonds of Rs. 30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise I, Aurungabad in connection with Madanpur P.S. Case No. 133 of 2024 subject to the condition laid down under Section 437(3) of the Cr.P.C. (Dr. Anshuman, J) Sunnykr/- U
