JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being the sister-in-law (Bhabhi) of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 364, 304B, 498A and 120B/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The accusation is of killing the daughter of the informant within few months of marriage for non-fulfillment of the dowry demand.
It is submitted by learned counsel for the petitioner that the petitioner is separate from the husband of the victim. Thrust of accusation against the husband of the victim. The husband of the victim and father-in-law of the victim have been acquitted vide S. Tr. No. 158/430 of 2003.
Patna High Court Cr.Misc. No.1599 of 2016 (2) dt.12-01-2016 2/2 Since the case was registered in the year 2001 and from the impugned order it appears that chargesheet was submitted showing the petitioner absconder, this Court is not inclined to interfere.
However, let the learned court below consider the prayer for regular bail of the petitioner if she surrenders within a period of six weeks in connection with Sadar P.S. Case No. 132 of 2001 pending in the court of learned CJM, Purnea keeping in view of the fact that the petitioner is a lady and the husband and fatherin-law of the victim have already been acquitted. Accordingly, the application is disposed of.
