2. Petitioner apprehends arrest in a case registered for the offence punishable under section 379 of the Indian Penal Code.

3. As per prosecution case, informant's motorcycle was stolen by unknown miscreants.

4. It is submitted on behalf of the petitioner that this petitioner is innocent and has falsely been implicated in this case. Petitioner's name has come in this case during course of investigation on the basis of confessional statement of coaccused. No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner has got no criminal antecedent of similar nature.

5. Learned counsel for the State opposes the prayer for pre-arrest bail.

6. Considering the aforesaid facts of the case, prayer for bail of this petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let this petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Sherghati, Gaya in Gurua Police Station Case No. 132 of 2024, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
