JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 399 and other ancillary sections of the Indian Penal Code and sections 25(1-B)a/26/35 of the Arms Act.

As per the prosecution case, the petitioner was apprehended with a country made pistol with a live cartridge and Aadhar card of one Vinod Kumar.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 28.3.2021. Charge sheet has already been submitted. Considering the aforesaid facts and circumstances of

Patna High Court CR. MISC. No.45798 of 2021(2) dt.16-11-2021 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Mahua Police Station Case No. 215 of 2021.
