JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-08-2019 This application, for grant of anticipatory bail, arises out of Excise Case No. 2232 of 2018 arising out of Sahar Police Station Case No. 263 of 2018, disclosing offences under Sections 30(a), 36, 37 (b) of the Bihar Prohibition Act, 2016. Allegation is that the police on information that some persons are engaged in manufacturing liquor, raided the place and on seeing the police accused persons started fleeing away, however, four persons were arrested on chase, who disclosed the name of petitioner and others as their associates and on search apparatus for manufacturing liquor as well as 60 litres of country made liquor was recovered.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case on the disclosure of apprehended accused persons and except that there is nothing

Learned counsel for the State opposed the prayer for bail, however, he admitted that there is no recovery from the house or at the instance of the petitioner rather his name has been disclosed by co-accused.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge-cum-Special Judge, Excise Act, Bhojpur at Arrah, in connection with Excise Case No. 2232 of 2018 arising out of Sahar Police Station Case No. 263 of 2018 subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
