ANJANA PRAKASH ORAL JUDGMENT Date: 11-05-2015 Heard learned counsel for the Petitioner and the State. The Petitioner seeks quashing of the order dated 28.9.2012 by which the Additional Sessions Judge-3, Danapur, in Sessions Trial No. 73 of 2011 refused an application under Sections 227/228 Cr. P.C.
Considering that even if charge under Section 307 is framed, no prejudice would be caused to the Petitioner and charge can be amended at any stage of trial, I am not inclined to interfere in the matter.
The application stands dismissed.
The Trial Court is directed to conclude the Trial
Patna High Court Cr.Misc. No.8798 of 2013 dt.11-05-2015 2/2 expeditiously without granting unnecessary adjournment to any Party for with reason, he is directed to send a list of the witnesses fixing specific dates for production of the witnesses along with a copy of this order in connection with Sessions Trial No. 73 of 2011 to the Superintendent of Police, Patna, and the Superintendent of Police, Patna is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial. Let the case diary be remitted to the Court concerned immediately.
