The petitioner is languishing in custody since 30.01.2019 in a case registered for the offence punishable under Section 392 of the Indian Penal Code.

It is alleged that while the informant was returning from his office, on the way, some unknown miscreants robbed laptop, finger print device, cash amount of Rs.7000/- and other documents from him, leading to registration of FIR against unknown. Subsequently, during investigation, the name of the petitioner sprang up.

It is submitted by learned counsel for the petitioner that neither the petitioner nor the recovered article has been put on TIP and the investigation has already been concluded. A

Learned APP for the State submits that the petitioner's name sprang up during investigation. Considering the fact that neither the petitioner nor the recovered article has been put on TIP, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-III, Motihari, East Champaran, in connection with Kesariya P.S. Case No. 42 of 2019.
