1. Heard Mr. Kedar Jha, learned counsel for the petitioner and Mr. Md. Shakir Ahmad, learned APP for the State.
2. The petitioner apprehends her arrest in connection with Bahadurpur (Sonaki O.P.) P.S. Case No. 408/ 2023 dated 06.08.2023 registered for the offence(s) punishable under Section(s) 341, 323, 324, 325, 307, 354B, 379, 504, 506 read with section 34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner is an old lady and against her there is no specific allegation in the F.I.R. and she is only alleged to have abused the injured, Ram Kashi Devi and the main allegation of inflicting Tengari blows on the person of Ram Kashi Devi is against co-accused, Nagendra Mahto and Vikash Kumar and the said occurrence is not said to have committed in the planned
Patna High Court CR. MISC. No.42291 of 2024(2) dt.20-07-2024 2/2 manner.
4. Learned APP appearing for the State opposed the bail prayer of the petitioner.
5. Having regard to the above submissions and mainly considering the nature of allegation appearing against the petitioner from the F.I.R. and taking into account the genesis of the occurrence, this court is inclined to accept the petitioner's anticipatory bail prayer. Accordingly, let the petitioner namedabove, in the event of her arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Bahadurpur (Sonaki O.P.) P.S. Case No. 408/ 2023 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
