2. The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a) and 32 of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. As per the prosecution case, 673.5 litres of illicit foreign liquor recovered from pickup vehicle.

4. Learned counsel for the petitioner submits that the petitioner is said to be the driver of the said vehicle. It is further submitted that the petitioner was made an accused in this case due to scuffle with the police personnel with regard to search and seizure and the petitioner had no knowledge whatsoever, of any liquor kept in the vehicle. There is violation of Sections 103 and 105 of the B.N.S.S.. The petitioner has no

5. Learned APP for the State opposed the grant of bail on the basis of allegations made in the First Information Report.

6. Taking into consideration the facts and circumstances and considering that the mandatory provisions of search and seizure have been violated and charge-sheet has been submitted, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise-I, Munger/concerned Court below in connection with Gangta P.S. Case No. 16 of 2026.
