The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341,323,325,379 and 307/34 of the Indian Penal Code. The prosecution case is that the accused persons were removing parts of the tractor of the informant when protest was made, petitioner no. 1 Gajendra Yadav assaulted the informant with Khanti on the head of informant's brother, petitioner no. 3 assaulted the informant with Khanti and petitioner no. 2 assaulted the informant and his brother with lathi. One of the injuries of the informant has been found to be grievous whereas
Patna High Court Cr.Misc. No.1759 of 2016 (2) dt.14-01-2016 2/2 other injuries are simple in nature.
It is submitted by the learned counsel for the petitioners that for the protest for taking the tractor through the land of the petitioners the accusation has been levelled. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Bihta P.S. Case No. 517 of 2015 pending in the court of learned JM Ist Class, Danapur. This application is disposed of with the aforesaid observation/direction.
