Petitioners apprehend arrest in a case registered for the offence punishable under Sections 147/ 148/ 149/ 188/ 341/ 323/ 307/ 332/ 333/ 427/ 504 of the IPC.

As per the prosecution case, 53 accused persons including the petitioners attacked the police forces as a result of which some of them sustained injury.

Learned counsel appearing for the petitioners submits

Patna High Court CR. MISC. No.36441 of 2022(2) dt.07-11-2022 2/2 that the petitioners are innocent and have falsely been implicated in this case. Allegation of commission of assault is general and omnibus in nature and no specific allegation has been made against these petitioners. Petitioners have got no criminal antecedent.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Muffasil Motihari P.S. case No. 573 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
