The petitioner seeks bail in a case registered for the offences punishable under sections 304(B), 120(B), 201/34 of the Indian Penal Code.
Petitioner is the husband. Prayer for bail of the petitioner was earlier rejected by order dated 28.01.2014 passed in Criminal Misc. No. 42537 of 2012.
Considering the facts aforesaid, prayer for grant of bail to the petitioner is again rejected in connection with Sessions Trial No. 306 of 2012/17 of 2012 arising out of Nabinagar P.S. Case No. 12 of 2012 pending in the court of the learned Additional Sessions Judge IV, Aurangabad. As the petitioner is in jail since 15.03.2012 i.e.
Patna High Court Cr.Misc. No.42925 of 2015 (2) dt.17-09-2015 for about three and a half years, the learned trial court is directed to expedite and hold trial of the petitioner on day to day basis and conclude the same within four months from the date of receipt/production of a copy of this order.
The Superintendent of Police, Aurangabad is directed to ensure attendance of the prosecution witnesses in the Session Trial aforesaid on the date fixed so that the trial must be concluded within the time aforesaid.
