ANJANA PRAKASH ORAL ORDER 2/ 18-01-2016 Heard learned counsel for the Petitioners and the State.
The Petitioners apprehend their arrest in a case instituted for the offence under Section(s) 147, 149, 323, 504, 379, 506 Indian Penal Code and Section 3(i)(x) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act. Considering the counter version of the occurrence and the fair antecedents of the Petitioners, it is ordered that in the event of surrender/arrest of the Petitioners, named above, within four weeks from the date of receipt/production of a copy of this order in connection with Ghorasahan P.S. Case No.407 of 2015,
Patna High Court Cr.Misc. No.2097 of 2016 (2) dt.18-01-2016 2/3 they shall be released on anticipatory bail on furnishing bail bond of `5,000/- (five thousand) each with two sureties of the like amount each or any other surety to be fixed by the court below to the satisfaction of the Sub-Divisional Judicial Magistrate, Sikrahana at Motihari, East Champaran, subject to the conditions as laid down under Section 438(2) Cr. P. C. and (i) That one of the bailors will be a close relative of the Petitioners, who will give an affidavit giving genealogy as to how he is related with the Petitioners.
