The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code, under Section 27 of the Arms Act, Section 17 of the C.L.A. Act and under different Sections of the U.A.P. Act. The petitioner and his two sons are alleged to have invited the brother of the informant to see a cultural programme while the cultural programme was going on extremists are said to have came and made indiscriminate firing causing death of three persons including the brother of the informant. It is submitted that the petitioner and his two sons only invited the brother of the deceased but no allegation is made against the petitioner. Similarly situated accused Vikram Singh
Patna High Court Cr.Misc. No.42576 of 2015 (2) dt.17-09-2015 2/2 and Uday Singh who happens to be sons of the petitioner have already been enlarged on bail vide orders passed in Cr. Misc. No. 17857 of 2015. The case of the petitioner stands on the same footing.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Narendra Pal Singh, the learned Judicial Magistrate 1st Class, Sherghati at Gaya in Barachatti (Mohanpur) P.S. Case No. 528 of 2013.
