In this case, dispute is with regard to measurement of some plots in question.

It has been submitted by learned counsel for the petitioner that his objection petition dated 06.07.2020 as

Patna High Court CWJC No.220 of 2021(5) dt.01-08-2022 2/3 contained in Annexure-3 to this writ petition has not been considered by the Circle Officer and measurement of land in question has been done.

Learned counsel for the State submits that the measurement of the land in question has been done in presence of the petitioner but the petitioner has not put his signature on the measurement report.

Learned counsel for the private respondents also supports the stand of the State.

Considered by the submissions of the parties. All the parties are in agreement that this case can be disposed of with a direction to the Circle Officer, Shahpur, District- Bhojpur, to consider the objection of the petitioner and thereafter get the land in question measured. In that view of the matter, the Circle Officer, Shahpur, District- Bhojpur is directed to consider the objection petition dated 06.07.2020 filed by the petitioner, as contained in Annexure-3 to this writ petition, and thereafter fix a date for measurement of the land in question and get the land measured in presence of the parties. If any of the parties do not cooperate, the measurement shall be done on the date fixed by the Circle Officer.
