JUSTICE SUDHIR SINGH ORAL ORDER 01-12-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 406 and 420 of the Indian Penal Code. Allegation against the petitioner is to have defalcated Government money which was entrusted to the PACS of Chandhari Panchayat to purchase paddy from the villagers of its area.

It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 16.7.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. Petitioner has been made accused due to mistake of fact. It is further submitted that petitioner is ready to deposit an amount of Rs.50,000/- in the court below which shall be subject to the final disposal of the case.

On behalf of the State, it is submitted that petitioner is

Patna High Court Cr.Misc. No.43867 of 2015 (3) dt.01-12-2015 2 / 2 named in the F.I.R.

However, it is directed that petitioner shall deposit a sum of Rs. 50,000/- in the court below which shall be subject to the final disposal of the case.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Hilsa, Nalanda, in connection with Islampur P.S. Case no. 293 of 2014.
