The petitioner seeks bail in connection with Agrer P.S. Case No. 04 of 2024 instituted for the offence under Sections 147, 148, 302, 436, 427 of the Indian Penal Code. 3.
Prosecution case in short while the police party was patrolling they received information that dead body of one 'Shivam Kumar' was found in front of the house of the Dashrath Singh. Whereafter, mob entered into the house of Dashrath Singh and murdered Chinta Devi, wife of Dashrath Singh and it is also alleged that mob set ablaze the motorcycle and also broken the house hold articles. Petitioner is alleged to be one of the members of mob who set ablaze the motorcycle in question.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 05-03-2024. Petitioner bears one criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner is not named in the FIR. Name of the petitioner has transpired in this case during course of investigation that too on suspicion. Learned counsel next submits that from perusal of the FIR itself, it would manifest that there is general and omnibus allegation levelled against the petitioner. It is submitted that during course of investigation, daughter-in-law of the deceased-Chinta Devi-made statement before police on 17-01-2024 against six accused persons and 50-60 unknown persons.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. It is submitted that daughter-in-law of the deceased -Chinta Devi-has filed application during course of investigation and has named six named accused persons and 50-60 unnamed accused persons, which fact finds mention at paragraph No. 23 of the case diary. Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and there being no direct involvement of the petitioner in this case, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Agrer P.S. Case No. 04 of 2024.
