2. The petitioner has filed the present application under Section 438 of the Indian Penal Code for grant of prearrest bail in connection with Mahila P. S. Case No.73 of 2017 in which, cognizance has been taken inter alia under Section 498(A) of the Indian Penal Code. The matter was earlier sent for mediation.
3. It is submitted by the learned counsel for the petitioner that the petitioner and the complainant are peacefully living together.
4. However, learned counsel appearing for the
Patna High Court CR. MISC. No.35111 of 2019(5) dt.16-11-2019 2/2 complainant submitted that though has information that the petitioner and the complainant are living together, he has no report that she is being kept well in her matrimonial home.
5. Regard being had to the nature of the allegations, the petitioner is directed to be released on bail, in the event of his arrest or surrender within four weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1st, (East), Muzaffarpur in connection with Muzaffarpur Mahila P.
