The petitioner apprehends his arrest in Gamharia P.S. Case No. 68 of 2016, registered for the offences punishable under Section 47 of Bihar Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner is not apprehended on the spot by the police and nothing has been recovered from the conscious possession of the petitioner. It appears that the petitioner along with others managed to flee away from there and from the shop of the petitioner 31 bottles of country made liquor was recovered.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
