JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was all along on bail but his bail bond was cancelled on 13.03.2008 as he could not appear before the court below.
It would appear from perusal of the impugned order that case of the petitioner was committed to the court of Sessions in the year 2005 and petitioner attended his trial for near about three years and after that he committed the default as stated above. The contention on behalf of the petitioner is that as a matter of fact, earlier the case record of the petitioner was pending before the court of Additional Sessions Judge-XII but subsequently, the case was transferred to the court of Additional
Patna High Court Cr.Misc. No.54906 of 2015 (2) dt.10-12-2015 2/2 Sessions Judge-I and the record could not be traced out as a result of which the bail bond of the petitioner was cancelled. It is further contended by him that as soon as the petitioner got knowledge of issuance of 82-83, he voluntarily surrendered before the court below on 29.06.2015 and since then he is languishing in jail custody.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Patna in connection with Sessions Trial No. 1227 of 2005 arising out of Kadamkuan (Kankarbagh) P.S. Case No. 14 of 2003.
