2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in a case instituted for the offence punishable under Sections 126(2), 115(2), 118(1), 109, 352, 3(5) of the BNS.

3. The prosecution case, in brief, is that while the informant had gone to the market, the petitioner, along with other co-accused persons, arrived at the spot and began abusing and physically assaulting him with fists and slaps. It is further alleged that co-accused Kamran

Patna High Court CR. MISC. No.36829 of 2025(2) dt.20-06-2025 2/3 Miya inflicted multiple knife blows on the informant, as a result of which he fell to the ground and sustained injuries.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. There is general and omnibus allegation against the petitioner and the specific allegation of assaulting by means of knife is leveled against coaccused Kamran Miya. From perusal of impugned order, it is evident that injury sustained by the injured is simple in nature. Moreover, several similarly situated co-accused persons have been granted bail by co-ordinate Bench of this Court (annexed as Annexure 2 and 3). A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer of bail.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated

The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Goreakothi P.S. Case no. 171 of 2024, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Siwan, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
