The petitioners are apprehending arrest in a case registered for the offences punishable under Section Prosecution case is that the accused persons including the petitioners took Rs.90,000/- on assurance that the informant will get Rs.35,000/- as salary after getting employment in Dubai but in Dubai he was getting only Rs.9000/- as salary. Thereafter, the informant returned to his country on the order of Labour Court at Dubai.
It is submitted by learned counsel for the petitioners that there is nothing on record to suggest that the payment was made to the petitioners or the petitioners were party in the whole
Patna High Court Cr.Misc. No.1868 of 2016 (2) dt.15-01-2016 2/2 act of getting the informant under employment. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. It is further submitted that co-accused Md. Hussain @ Bechan, Md. Ibran @ Md. Abrar Alam and Intkal Alam @ Intkhab Alam, have been granted anticipatory bail by a co-ordinate bench of this Court vide Criminal Miscellaneous No.55208/2015.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Jhanjharpur in connection with Laukahi P.S. Case No.8/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
