The petitioner seeks bail in a case registered for the offences punishable under Sections 365, 386, 387, 34 and 395 of the Indian Penal Code.

The petitioner is not named in the FIR. The petitioner was apprehended on mere suspicion. The I.O. took the confessional statement of the petitioner in which the petitioner is said to have disclosed that he along with other accused persons robbed the informant of his belongings and money. Co-accused Md. Nadim is also said to have confessed his guilt and disclosed the name of the petitioner. The petitioner has not been put on test identification parade although he is in custody since 19.01.2015. No incriminating article has been recovered from the possession of

Patna High Court Cr.Misc. No.44614 of 2015 (2) dt.24-09-2015 2/2 the petitioner. Similarly situated co-accused Md. Salam has already been enlarged on bail vide orders passed in Cr. Misc. No. 19023 of 2015.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-IV, Patna in Gardanibagh P.S.
