The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 451, 324, 307, 354, 506/34 of the Indian Penal Code.

Prosecution case is that one Savita Kumari D/O Kamla Dubey gave a written report to the police on 15.01.2019 to the effect that in the morning at 7.30 A.M. one Ajay Yadav and Sanjay Yadav (full brothers) came at her house and asking about male members. She told none in present then they started to torn her dress and also assaulted her with knife. Then she raised alarm then her Bhabhi Pratibha came and in course of scuffle she also became injured, then her elder mother came and people gathered there and caught hold Ajay Yadav and his motorcycle. But Sanjay Yadav fled away having pistol in hand.

Learned counsel for the petitioner submits that wife of

No.36133 of 2019(3) dt.13-08-2019 2/2 the petitioner namely Sumti Singh (a teacher) lodged a case against the brother of the informant namely Pintu Dubey who attempted to outrage the modesty of Sumti Singh and has mentioned in Annexure-2 of the bail petition. Learned counsel for the petitioner further submits that at the time of occurrence petitioner was fully engaged in the examination of Business Management, Patna and he was never present at occurrence. The injury report of the informant and her Bhabhi are not serious in nature. The petitioner is clean antecedent.

In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Navanagar P.S. Case No. 14 of 2019 to the satisfaction of the learned Chief Judicial Magistrate, Buxar, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
