Petitioner is not named in the first information report but it is stated that in course of investigation, the mobile set which had been used in committing the present crime was recovered from conscious possession of the petitioner. The submission on behalf of the petitioner is that no mobile set was recovered from conscious possession of the petitioner and as a matter of fact, the police implicated the petitioner in collusion with the informant of the present case. Moreover, the petitioner does not have any criminal antecedent and the petitioner is languishing in jail custody since 29-06-2015.

No.42675 of 2015 (2) dt.17-09-2015 2/2 Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bettiah Muffasil (Manuapul) P.S. Case No. 352 of 2015 to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran.
