Patna High Court CWJC No.6858 of 2018(3) dt.02-08-2022 2/3 ORAL ORDER 02-08-2022 Though the present writ petition has been filed seeking quashing of the notice dated 19.03.2018 passed in Encroachment Case No. 1 of 2016-17 issued to the petitioners, however, it is the submission of the learned counsel for the petitioners that without passing any final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, the Circle Officer, Mahishi i.e. the respondent no. 3 is seeking to remove the alleged encroachment forcibly despite the fact that the petitioners have got an interim injunction vide order dated 15.11.2021 passed in Civil Miscellaneous Appeal No. 2 of 2018, by the learned District Judge, arising out of Title Suit No. 504 of 2016, pending before the learned Court of Sub-Judge-1, Saharsa, hence it is submitted that the petitioners be granted opportunity to approach the respondent no. 3 by filing appropriate objection/reply, bringing to his notice the aforesaid facts so that the respondent no. 3 can take appropriate decision, in accordance with law.

The learned counsel for the respondent-State submits that the State-respondents do not have any objection to the aforesaid proposal of the learned counsel for the petitioners. Having regard to the facts and circumstances of the case, the present writ petition stands disposed off with liberty to

It is needless to state that till the respondent no. 3 takes a final decision in the aforesaid encroachment case No. 1 of 2016-17, status quo existing as on today, shall be maintained.
