JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-08-2019 This is an application for grant of anticipatory bail in connection with Buxar (Muffasil) P.S. Case No. 111 of 2019 disclosing offences under Sections 341, 323, 354(B), 504, 506 and 509 of IPC.

Allegation as per F.I.R. is that petitioner tried to outrage the modesty of the informant and when she protested, he assaulted her.

Submission of the learned counsel for the petitioner is that whole allegation is false and concocted as there was a dispute with respect to drainage, which will appear that there is a delay of 05 days in lodging the F.I.R.

Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the

Patna High Court CR. MISC. No.34361 of 2019(3) dt.02-08-2019 2/2 court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Buxar (Muffasil) P.S. Case No. 111 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
