The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Amendment Act, 2016. It is a case of recovery of 20 liters of country made liquor from the possession of the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. Petitioner has clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

After considering the aforesaid facts and circumstances of the case as well as the fact that the liquor was

Patna High Court CR. MISC. No.37922 of 2022(2) dt.23-09-2022 2/2 recovered from the possession of the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner is rejected.
