JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 18-01-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Kurtha P. S. Case No. 23 of 2015 registered under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code. It is contended that the informant was authorized by the South Bihar Power Distribution Company Ltd. (for short 'the Company') to collect money from the consumers. He misappropriated the same and for that the Company itself has instituted an FIR against the informant of the present case and in order to save his own skin, the informant has tried to shift the burden upon the petitioner by instituting a false and concocted case. It is further contended that no chit of paper regarding

Patna High Court Cr.Misc. No.2343 of 2016 (2) dt.18-01-2016 2/2 allotment of work for collecting money from the consumer has been brought on record by the informant.

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above, who is reported to be a man of clean antecedent, is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal in Kurtha P. S. Case No. 23 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
