The petitioner apprehend his arrest in connection with Sarairanjan P.S. Case No.216 of 2020, registered for the offences punishable under Sections 302 and 120B of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. It is further submitted that there is general and omnibus allegation against the petitioner. The specific allegation is against co-accused, Golu Kumar @ Aditya Raj and Bhanu Jha who fired upon the deceased. It is lastly submitted that the petitioner has got no criminal antecedent as stated in paragraph-

Patna High Court CR. MISC. No.46183 of 2021(3) dt.13-07-2022 2/2 3 of the bail application.

The learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the facts that the allegation against the petitioner is general and omnibus and the petitioner has got no criminal antecedent, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Samastipur in connection with Sarairanjan P.S. Case No.216 of 2020, subject to the conditions laid down under Section 438 (2) of the Code of Criminal Procedure.
