JUSTICE SUDHIR SINGH ORAL ORDER 09-11-2015 Heard the counsel for the petitioners and counsel for the State.
The petitioners are languishing in jail since 20.03.2015 in a case instituted under Sections 363, 302 and 201/34 of the Indian Penal Code in connection with Baisi P.S.Case No.17 of 2015 pending in the Court of CJM, Purnea.
As per allegation, it is a case of kidnapping of the
Patna High Court Cr.Misc. No.42999 of 2015 (3) dt.09-11-2015 informant's daughter and thereafter murder by the accused persons.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 20.03.2015. Chargesheet has been submitted in the case. Petitioners have got no criminal antecedent. Petitioners have falsely been implicated in the present case. Petitioners are not named in the FIR.
On behalf of the State and the counsel for the Informant, it has been submitted that on the confession of the husband of the deceased, the dead body of the deceased is said to have been recovered along with other articles. The husband of the deceased has admitted regarding participation of the petitioner in the alleged occurrence.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the above named petitioners, same is dismissed.
Anyhow, the court below is directed to expedite the trial and conclude the same preferably within a period of one year from the date of receipt/production of a copy of this order. (Sudhir Singh, J) B.Kr./- U T
