Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 25.8.2018 passed in Cr. Misc. No.48444 of 2018 on merit with a direction to the petitioner to surrender and pray for regular bail which will be considered by the learned Special Judge in spite of that second application has been filed on the ground that some points could not be raised at that time and this is not case of forgery in the mark-sheet rather this a case that he has improved in the marks by appearing second time.

Heard learned A.P.P. and the learned counsel for the C.B.I..

Having heard both sides and in view of the facts

Patna High Court CR. MISC. No.40789 of 2019(4) dt.21-08-2019 2/2 and circumstances, as stated above, I am not inclined to interfere with the earlier order passed by this Court and he is directed to surrender and pray for regular bail.

With the aforesaid direction, this application is dismissed.
