JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-08-2019 This is an application for grant of anticipatory bail in connection with Lalganj P.S. Case No. 101 of 2019, disclosing offences under Sections 30(a), 32(2) and 41(1) of the Bihar Prohibition and Excise Act, 2016.

Allegation of recovery of 135 liters of liquor from the Magic vehicle and two persons were arrested there and 09 Cartoons of foreign liquor was also recovered from the Maruti Swift Car and petitioner happens to be the owner of the Magic vehicle.

Submission of the learned counsel for the petitioner is that he was not present at the time of occurrence and except that he is owner of the Magic vehicle, nothing against him. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and

No.35489 of 2019(3) dt.09-08-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner may move before the learned court below for regular bail which will be considered by the learned court below and if possible, be disposed of on the same day.
