2. The petitioner seeks bail in connection with Bodh Gaya P.S. Case No. 718 of 2023 in S.T. No. 838 of 2024 instituted for the offences under Sections 302, 201/34 of the Indian Penal Code.
3. Prosecution case, in short, is that, on 03.09.2023, the informant's son went out but did not return, and his dead body was later found in Nimiya Ahar. The informant suspects that unknown criminals murdered his son and dumped his body.
4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Petitioner is not named in the F.I.R. The name of the petitioner
Patna High Court CR. MISC. No.40872 of 2025(2) dt.08-07-2025 2/3 transpired in this case during investigation merely on the basis of suspicion. No specific overt act is alleged against the petitioner. Learned counsel further submitted that, police, during investigation, found one lady, namely, Karuna Devi who has alleged herself to be eye-witness to the alleged occurrence and she has disclosed the names of the three accused persons including the petitioner. Charge-sheet has been submitted in this case. It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.06.2024 and has one criminal antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Learned APP further submitted that the prayer for grant of bail to the coaccused person has already been rejected by a coordinate Bench of this Court vide order dated 24.04.2024 passed in Cr. Misc. No. 14818 of 2024. He further submitted that, from perusal of the said order, it appears that one Karuna Devi has categorically stated before the police and the Magistrate under Sections 161 and 164 of the Cr.P.C. that the accused persons including the petitioner have killed the deceased in her presence.
6. Considering the aforesaid facts and circumstances of the case this Court is not inclined to grant bail to the
Patna High Court CR. MISC. No.40872 of 2025(2) dt.08-07-2025 3/3 petitioner at this stage.
7. Accordingly, the prayer for grant of bail to the petitioner is, hereby, rejected.
