The petitioners apprehend their arrest in Fatuha P.S. Case No.36 of 2021, registered for the offences punishable under Sections 447, 341, 323, 325, 379, 504, 506, 307 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. There is general and omnibus allegation against the petitioners. It is further submitted that specific allegation is against Mithlesh Gope and Amar Gope who assaulted the family members of the informant and the injury sustained by Ashok Kumar Sinha is grievous in nature as mentioned in the case

Patna High Court CR. MISC. No.46215 of 2021(4) dt.08-08-2022 2/2 diary. It is submitted that the petitioners are the order giver. It is lastly submitted that petitioner no.1 has got one criminal antecedent and petitioner no.2 has got no criminal antecedent as stated in paragraph-3 of the bail application. It is also submitted that similarly situated co-accused, Mithilesh Gope @ Mithlesh Rai has already been enlarged on anticipatory bail by this Court vide order dated 11.07.2022, passed in Cr. Misc. No.58969 of 2021.

Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Patna City in connection with Fatuha P.S. Case No.36 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Anjani Kumar Sharan, J) Sanjay/- U T
