The petitioners seek bail in a case registered for the offences punishable under Sections 302 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act. The informant Pramod Kumar named as many as 15 persons in the FIR including both the petitioners and alleged that Nagendra Kunwar assaulted with axe on his head. Harendra Kunwar assaulted Samundra Kunwar with axe then the informant's cousin Pappu Kunwar came to save Amarendra Kunwar also assaulted him with Pharsa on his head. Awadhesh Kumar Singh and Pramod Kumar Singh assaulted the informant's brother Arbind Kumar with spear. Arbind Kumar and Samundra Kunwar also got severe injuries. It is said that Arbind Kumar died

Patna High Court Cr.Misc. No.42881 of 2015 (2) dt.18-09-2015 2/2 during the course of treatment. There is no specific allegation of assault against the petitioners.

It is submitted that Arbind Kumar got one injury on head and other injuries are on different parts of the body which are not vital to cause death.

Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Amit Kumar Singh, the learned Judicial Magistrate, 1st Class, Chhapra at Saran in Panapur P.S. Case No. 48 of 2014.
