JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-09-2022 The present writ petition has been filed seeking the following reliefs:- "I. For issuance of an appropriate writ in nature of mandamus for commanding and directing the respondent authorities concerned to remove the encroachment caused by the private respondent Parmeshwar Sah and his sons at village-Sipah, P.S. No. 354, Khata No. 213, Survey No. 808, total area 04 katha and 01 dhur by keeping Naad Khuta and Gumti, which is causing great difficulties to the petitioner, his family members and other villagers as the land, which has been encroached by the private respondent is the village road."

Patna High Court CWJC No.4413 of 2021(2) dt.01-09-2022 2/2 II. For issuance of an appropriate writ in the nature of mandamus for commanding and directing the respondent District Magistrate, Siwan or the Circle Officer, Basantpur, Siwan to initiate Encroachment proceedings against the private respondent Parmeshwar Sah and his sons and remove the encroachment caused by them on public road situated at village-Sipah, P.S. No. 354, Khata No. 213, Survey No. 808, total area 04 katha and 01 dhur."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Baniyapur, District-Saran for redressal of his aforesaid grievances.

Liberty so sought is granted.

The writ petition stands disposed off.
