The petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120(B), 34 and 427 of the Indian Penal Code and under Section 27 of the Arms Act. The petitioner is not named in the FIR. The father of the deceased named six persons and two unknown persons and alleged that Ajay Yadav, Pankaj Pandey and others assaulted his son. Bibhuti Pandey fired which hit his son. Ajay Yadav also fired but his shot did not hit his son. Name of the petitioner figured in the case during the course of investigation and petitioner is said to have confessed his guilt. The informant has made very specific allegation against Bibhuti Pandey that he fired which hit his son causing his death. Other accused persons namely Pankaj Pandey,

Patna High Court Cr.Misc. No.45369 of 2015 (2) dt.30-09-2015 2/2 Lal Baba @ Ajay Mishra have already been enlarged on bail. The case of the petitioner stands on better footing. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions JudgeII, Jamui in Sessions Trial No. 191 of 2015, arising out of Laxamipur P.S. Case No. 59 of 2015.
