JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-09-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as well as learned counsel appearing on behalf of the informant. Petitioner happens to be elder brother of the co-accused Noor Alam with whom informant solemnized her marriage. No specific overt act has been attributed against the petitioner in the First Information Report except to this extent that he attended Panchayati before the marriage of the informant with co-accused Noor Alam.

Learned counsel for the informant submits that after investigation, Police filed chargesheet under Section 376, 498(A), 341, 323, 420 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act and, therefore, perusal of the case diary is

Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, (West), Muzaffarpur in connection with Karja P.S.
