JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-04-2019 Learned counsel appearing on behalf of the petitioner with reference to Annexure-C to the counter affidavit would submit that the respondents are keeping the matter of encroachment pending for years together and no action is being taken for removable of encroachment. He submits that counter affidavit indicates that proceeding was initiated on 15.09.2017. We are in 2019. Approximately two years have passed. Considering the fact that the matter is still pending,

Patna High Court CWJC No.1671 of 2018(5) dt.29-04-2019 2/2 the Court directs the Circle Officer, Mahrajganj to take up the pending Encroachment Case No. 5 of 2017-18 to its logical conclusion within a maximum period of four months from the date of receipt/production of copy of this order. The Circle Officer is also required to pass order for removable of encroachment after hearing the parties likely to be adversely affected.

With the aforesaid, the writ petition stands disposed of.
