At the very outset, it is pointed out on behalf of the petitioner that the victim had voluntarily left her home and she was major at the time of alleged occurrence. It is further contended by him that petitioner also wanted to marry the victim but it is informant, who had created problem in the marriage of the petitioner and victim.
The statement of victim has been recorded under section 164 of the Cr.P.C in which she has stated that she had left her home voluntarily with an intent to solemnize her marriage with
Patna High Court Cr.Misc. No.44733 of 2015 (2) dt.24-09-2015 2/2 the petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sadar at Motihari, East Champaran in connection with Muffasil ( Lakhaura) P.S.Case No. 99 of 2015.
