JUSTICE RAVI RANJAN ORAL ORDER 02-03-2016 In view of the limited prayer made at the time of hearing of this writ application which has been filed on 08.01.2016 assailing the order dated 19.12.2015 passed by the Sub-Divisional Officer, East Muzaffarpur cancelling his PDS licence but without availing the alternative statutory remedy of appeal provided under Clause 15 of the Public Distribution System (Control) Order, 2001, the same is being disposed of granting liberty to the petitioner to avail the aforesaid remedy. In case the appeal is filed within four weeks then let the same be considered and disposed of on its own merit and in accordance with law without going into the issue of limitation as this writ application was filed on 08.01.2016 within 30 days from
Patna High Court CWJC No.512 of 2016 (2) dt.02-03-2016 2 / 2 the date of passing of the impugned order. It is expected that, thereafter, the appellate authority will proceed to dispose of the matter within the statutory period prescribed under Clause 15 of the aforesaid Control Order.
