Petitioner is apprehending his arrest in connection with Complaint Case No.255©/2018 , registered for offences punishable under Sections 323, 324, 498(A) of the Indian Penal Code and Section 3⁄4 of the D.P.Act.

As per the complaint case the petitioner happens to be husband of the complainant and there is allegation of demand of Rs.01 lac and for that subjecting her to cruelty . Submission of the learned counsel for the petitioner is that the allegation is false and concocted and he is still ready to keep the complainant with dignity and care and such submission had been made before the learned Sessions Judge also but the same has not been considered. It appears that on appearance of the O.P.no.2 the matter was referred to the

Patna High Court CR. MISC. No.35545 of 2019(5) dt.07-11-2019 2/2 Mediaton Centre but the mediation failed.

Nobody appears on behalf of the O.P.no.2 though she has appeared by filing vakalatnama.

Further submission of the learned counsel for the petitioner is that before the mediator also O.P.no.2 was not ready to reside with the petitioner.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Masaurhi, District Patna in connection with Complaint Case No.255© of 2018 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure with condition that if she is ready to reside with the petitioner he has to keep her with dignity and care..
