2. The petitioner apprehends his arrest in a case registered for the offence under Sections 342/506 of the Indian Penal Code, Section 8/12 of the POCSO Act, Section 66(e)/67(a) of the I.T. Act and Sections 9(i)(r)(s)(w)/3(2)(Va) of the SC & ST (POA) Act.

3. It is alleged that on the point of pistol, this petitioner forcibly took photograph of daughter of informant on his mobile phone and thereafter, made it viral on social media. It is further alleged that when informant went to the house of petitioner, he was abused by informant's father by his caste name.

4. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case due to old enmity. There is no allegation of any sexual assault against this petitioner. The

Patna High Court CR. MISC. No.41800 of 2023(3) dt.18-09-2023 2/2 alleged occurrence did not take place in public view and as such, no case under the SC/ST Act is made out. Petitioner has got clean antecedent.

5. Learned A.P.P. for the State and learned counsel for the informant vehemently opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 3rd cum Special Judge POCSO, Biharsharif (Nalanda) in connection with Karaiparsurai P.S. Case No. 16 of 2023 (Special POCSO Case No. 15 of 2023), subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
