The petitioner seeks bail in Dumariya P.S. Case No. 55 of 2018, registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code, sections 25(1-b)a, 26, 27 and 35 of the Arms Act, sections 3, 4, 5 of the Explosive Substance Act and sections 16, 18 and 20 of the Unlawful Activities (Prevention) Act.

As per the prosecution case, allegation against the petitioner is that he is active member of Naxalites movement and on raid several incriminating articles were recovered from the petitioner and others.

It is submitted on behalf of the petitioner that nothing has been recovered from conscious possession of this petitioner. Petitioner is not named in the FIR and merely on suspicion he

Similarly situated coaccused has been granted bail by this Court vide order dated 09.09.2021 passed in Cr. Misc. No. 9320 of 2021. Petitioner is in custody since 30.07.2020. Chargesheet has already been submitted.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Dumariya P.S.
