JUSTICE RAKESH KUMAR ORAL ORDER 03-07-2019 Heard Sri Dhaneshwar Prasad Gupta, learned counsel for the petitioner and learned Addl. Public Prosecutor. This is ploy for being released by way of filing the present petition for grant of provisional bail. Twice, the prayer for bail of the petitioner was rejected considering the seriousness of accusation.

Fact remains that the petitioner is in custody in Sessions Trial No.381(A) of 2018(arising out of Nasriganj P.S. Case No.208 of 2017) for offence relating to kidnapping for ransom. It is evident that ransom amount was also recovered from the possession of the petitioner.

In the present petition, a plea has been taken that the petitioner requires immediate medical facility for ailment of his eyes. On examination of the order dated 24.04.2019 passed by

Patna High Court CR. MISC. No.38743 of 2019(2) dt.03-07-2019 2/2 the learned court below, it is evident that the court below has noticed that Government is already taking appropriate steps for his treatment. In such situation, there is no reason to entertain the prayer for provisional bail.

The petition stands dismissed.
