The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code.
It is a case of abduction of the daughter of informant.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in the present case. It is also submitted that victim is a major girl and she went with the petitioner with her free will. As per impugned order victim has recorded her statement under Section 164 of Cr.P.C. in which she
Patna High Court CR. MISC. No.37925 of 2022(2) dt.30-11-2022 2/2 stated that she was in love with the petitioner and has already solemnized marriage with the petitioner and she wants to live with him. It is also submitted that there is inordinate delay of 15 days in lodging the F.I.R. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sasaram, Rohtas in connection with Sheosagar P.S. Case No. 226 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
