The petitioner seeks bail in Ishakchak P.S. Case No. 49 of 2021 corresponding to NDPS Case No. 23 of 2021, registered for the offence punishable under Sections 276, 419 and 420 of the Indian Penal Code, sections 18(C), 27(b)(ii), 28, 28(A)36(AC) of the Drugs and Cosmetics Act and sections 08/20/21/22 of the NDPS Act.

As per the prosecution case, 284 bottles of cough syrup each containing 100 ml., 300 gms. of Ganja, cash of Rs. 2205/- and mobile phone have been recovered from possession of this petitioner.

It is submitted on behalf of the petitioner that nothing has been recovered from conscious possession of this petitioner.

Patna High Court CR. MISC. No.46743 of 2021(2) dt.17-11-2021 2/2 Recovery has been made from the house which is in joint possession of family. The alleged recovered Ganja is of small quantity. Petitioner is a lady and she is in custody since 06.04.2021 having clean antecedent. Chargesheet has already been submitted.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Bhagalpur in connection with Ishakchak P.S. Case No. 49 of 2021.
