The petitioner apprehends his arrest in Kasba P.S. Case No.183 of 2020, registered for the offence punishable under Section 392 of the Indian Penal Code.

The prosecution case, in brief, is that on 30.12.2020 at about 4.30 P.M., the informant was going to Kasba Bazar for some work and when the informant reached near Jharnapul situated at NH-57, three persons came on a motorcycle and told the informant to stop his motorcycle. Two of the accused persons came near the informant and snatched the key of the motorcycle. The accused persons snatched two mobile phones and Rs.32,000/- from the pocket of the informant and fled away. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.46607 of 2021(2) dt.22-04-2022 2/2 present case. It is further submitted that the petitioner is not named in the FIR. On the basis of confessional statement of the co-accused, the name of the petitioner surfaced in the case. It is also submitted that the petitioner has got no criminal antecedent as stated in paragraph 3 of the bail application. Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea in connection with Kasba P.S. Case No.183 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
