JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 29-02-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offences punishable under sections 302 and 34 of the I.P.C and section 27 of the Arms Act.

Allegedly, the petitioner, co-accused Sanjay Singh, Dhananjay Singh and Yogendra Singh came at the door of the informant being armed with deadly weapons, the petitioner and Dhananjay Singh opened indiscriminate firing on Rajesh Kumar, the son of the informant, causing multiple injuries and he fell down on the ground and thereafter co-accused Sanjay Singh and Raushan Kumar made indiscriminate firing on Ram Janam Singh, the husband of the informant, who also fell down and both died. No.46140 of 2015 (4) dt.29-02-2016 2/2 informant in her further statement has stated that the petitioner, Dhananjay Singh, Sanjay Singh and Raushan Kumar opened firing upon the son of the informant and co-accused Raushan Kumar opened firing on her husband, co-accused Sanjay Singh and Yogendra Singh have already been allowed bail by different Benches of this Court and as such the petitioner who is suffering in custody since 25.06.2014 also deserves sympathetic consideration as against the petitioner there is no specific allegation.

The learned A.P.P. opposes prayer for bail by submitting that the petitioner and co-accused Dhananjay Singh opened firing upon Rajesh Kumar, son of the informant, causing multiple injuries resulting he died.

In the facts and circumstances as stated above, considering the allegation attributed against the petitioner, serious in nature, at this stage this Court is not inclined to enlarge the petitioner on bail and accordingly his such prayer stands rejected in connection with Khusrupur P.S. Case No. 08 of 2014 pending in the court of the Additional Sessions Judge-IV, Patna City, Patna.
